1. Agreement to These Terms

These Terms and Conditions (“Terms”) govern your access to and use of the website at jonayrea.clients-demo-website.com (the “Website”) and your purchase of products and services from Michiana Water Conditioning (“Michiana Water,” “we,” “us,” or “our”), including water softeners and conditioners, whole-house filtration, drinking water and reverse osmosis systems, water testing, bottled water, water coolers, salt delivery, and installation, service, and repairs (together, the “Products and Services”).

By using the Website, requesting a quote, placing an order, or making a payment, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website or our Products and Services. If you are using the Website on behalf of a business, you represent that you have authority to bind that business.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to place orders or make payments through the Website.

3. Website Use

You agree to use the Website only for lawful purposes. You will not:

• submit false, misleading, or fraudulent information, or use someone else’s payment method without authorization;
• attempt to gain unauthorized access to the Website, our systems, or other users’ data;
• introduce viruses, malicious code, bots, or scrapers, or interfere with the Website’s operation;
• use the Website to harass, defame, or harm others; or
• copy, resell, or exploit any part of the Website without our written permission.

We may suspend or restrict access to the Website at any time, without notice, if we believe these Terms have been violated.

4. Information on the Website; No Guarantees

The Website provides general information about water treatment. We try to keep it accurate, but descriptions, images, specifications, and availability may change or contain errors. Water conditions vary by location and source, and results depend on your water, plumbing, usage, and equipment maintenance.

Statements about hard water, filtration, taste, odor, or other water quality concerns are general in nature. Results are not guaranteed.

Water treatment equipment is not a substitute for professional medical, plumbing, or public-health advice. Our Products and Services are not intended to treat or cure any disease or health condition.

Unless a product is expressly certified for a specific contaminant claim, we do not represent that it will remove that contaminant. Product certifications (for example, NSF/ANSI) apply only to the specific claims listed on the product’s performance data sheet.

5. Water Testing

On-site or in-home testing provides a snapshot of your water at the time and place the sample is taken and generally covers common indicators such as hardness, iron, pH, and similar items. It is not a comprehensive analysis of all possible contaminants.

Where we arrange more detailed laboratory testing, results come from the third-party lab. We are not responsible for lab errors or delays.

Test results do not constitute a certification of water safety. If you have health concerns about your drinking water, contact your local health department or a certified laboratory.

Fees for testing, if any, will be disclosed before the test is performed.

6. Quotes, Orders, and Pricing

Quotes and estimates. Quotes are valid for the period stated on the quote (or [30] days if none is stated) and are based on the information you give us and the conditions we observe. Pricing may change if site conditions, plumbing, electrical, or drain requirements differ from what was described.

Order acceptance. An order is not final until we accept it. We may decline or cancel an order (including because of pricing errors, availability, or suspected fraud), and will refund any amount paid for a cancelled order.

Prices. All prices are in U.S. dollars and may change without notice. Prices exclude applicable sales tax unless stated. We charge Indiana sales tax where required.

Special orders. Items ordered specifically for you may be non-cancellable or subject to a restocking fee, as disclosed at the time of order.

7. Payments

7.1 Payment Processing by Square

Online payments, including bill payments, are processed by Square (a service of Block, Inc.). By paying online, you agree to Square’s applicable terms and privacy notice and authorize us and Square to charge your selected payment method for the amount you approve. We do not store your full card number or security code. We are not responsible for Square’s service interruptions, errors, or security practices, though we will work with you to resolve payment problems.

7.2 Accepted Payment Methods

We accept the payment methods displayed at checkout or on the payment page, which may include major credit and debit cards and digital wallets. We also accept other forms of payment in person or by phone as we make available.

7.3 Authorization and Accuracy

You represent that you are authorized to use the payment method you provide and that the billing information is accurate. You are responsible for entering the correct invoice number and amount when using the “Pay My Bill” feature. We may verify payments and delay or cancel any transaction we reasonably suspect is fraudulent.

7.4 Invoices, Balances, and Late Payment

Invoices are due on the date stated on the invoice or, if none is stated, within [30] days. Unpaid balances may be subject to a late fee to the extent permitted by Indiana law, and we may suspend service or deliveries on past-due accounts. You are responsible for reasonable collection costs, including attorney fees, as permitted by law.

7.5 Declined, Failed, or Disputed Payments

If a payment is declined or reversed, you remain responsible for the full amount owed, and we may charge a returned-payment fee of [$__] where allowed by law. If you believe you have been charged in error, contact us promptly at 574-295-8494 or michianawater@mail.com before disputing the charge with your card issuer so we can resolve it quickly.

7.6 Saved Payment Methods and Recurring Charges

If you choose to save a payment method or enroll in recurring salt, bottled water, or service billing, you authorize us to charge that payment method on the schedule and amounts you agreed to until you cancel. You may cancel recurring billing at any time by contacting us at least [3] business days before the next scheduled charge. We will notify you of price changes before they take effect.

7.7 Receipts

Square or we will send an electronic receipt to the email address you provide. Please keep it for your records.

8. Delivery, Installation, and Service

Scheduling. Delivery, installation, and service dates are estimates, not guarantees. Weather, product availability, and other factors may cause delays. We are not liable for delays outside our reasonable control.

Access and site readiness. You agree to provide safe, clear access to the work area and to ensure that existing plumbing, electrical service, drains, and water supply are adequate and in working order. Additional work required to install equipment (such as plumbing modifications) may result in additional charges, which we will discuss with you before proceeding.

Existing conditions. We are not responsible for pre-existing defects, deteriorated pipes or fixtures, or conditions that become apparent only when work begins. Normal installation may cause temporary disruption to your water supply.

Salt, bottled water, and coolers. Delivery schedules, minimums, container deposits, and equipment rental terms will be disclosed at the time of order. Rented coolers and equipment remain our property and must be returned in reasonable condition; you may be charged for loss or damage.

Appointments. Please give at least [24] hours’ notice to cancel or reschedule. We may charge a trip fee for missed appointments or if we cannot access the property.

9. Returns, Cancellations, and Refunds

Unused products. Unused, undamaged items in original packaging may be returned within [30] days of purchase with proof of purchase, subject to any restocking fee disclosed at the time of sale.

Non-returnable items. Installed equipment, special-order items, opened filters and media, salt that has been delivered, and completed services are generally non-refundable, unless the item is defective or the work was not performed as agreed.

Cancellation. You may cancel an order before installation or delivery by contacting us. Cancellation after special-order items have been purchased or labor has begun may be subject to charges for costs already incurred.

Door-to-door and off-premises sales. If you purchase Products or Services at your home in a sale that qualifies under the FTC Cooling-Off Rule or Indiana’s home solicitation sales law, you may have the right to cancel within three business days. We will provide any required notice at the time of sale.

Refund method. Approved refunds are issued to the original payment method through Square and may take [5–10] business days to appear, depending on your bank or card issuer.

10. Warranties

Manufacturer warranties. Most equipment we sell carries a manufacturer’s warranty. Its terms, duration, and exclusions are set by the manufacturer. We will provide the warranty details at the time of sale and can help you submit a warranty claim.

Workmanship. We stand behind our installation and service work for [__ days/months] from completion, covering defects in our workmanship. This does not cover damage resulting from misuse, neglect, alteration, freezing, power surges, abnormal water conditions, failure to maintain the equipment, or work by anyone other than us.

Maintenance. Water treatment equipment requires regular maintenance (such as salt, filter or media changes, and periodic service). Failure to maintain equipment may void warranties.

DISCLAIMER. EXCEPT FOR THE WRITTEN WARRANTIES EXPRESSLY STATED ABOVE OR PROVIDED BY THE MANUFACTURER, THE WEBSITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MICHIANA WATER CONDITIONING AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF USE), OR FOR ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE, PRODUCTS, OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THESE TERMS, THE WEBSITE, OR OUR PRODUCTS AND SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

12. Indemnification

You agree to indemnify and hold harmless Michiana Water Conditioning and its owners, employees, and agents from claims, damages, and expenses (including reasonable attorney fees) arising from your violation of these Terms, your misuse of the Website, your violation of any law or third-party right, or inaccurate information you provide, except to the extent caused by our negligence or willful misconduct.

13. Intellectual Property

The Website and its content, including text, graphics, logos, images, product descriptions, and design, are owned by or licensed to Michiana Water Conditioning and protected by copyright, trademark, and other laws. You may view and print content for personal, non-commercial use. You may not copy, modify, distribute, or create derivative works without our written permission. Manufacturer names, logos, and product names are the property of their respective owners.

14. Testimonials and User Content

Testimonials on the Website reflect the experiences and opinions of individual customers. Individual results will vary. If you send us a review, photo, or other content, you grant us a non-exclusive, royalty-free license to use, display, and reproduce it for business and marketing purposes, and you confirm that you own it or have permission to share it. We will not publish your full name or identifying details without your consent.

15. Third-Party Links and Services

The Website may link to third-party sites and services, such as Square, maps, and manufacturers. We do not control and are not responsible for them. Your use of third-party services is at your own risk and subject to their terms.

16. Privacy

17. Communications

By providing your email address or phone number, you consent to receive transactional communications (such as invoices, receipts, appointment reminders, and delivery notices). 18. Force Majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including severe weather, natural disasters, utility or internet outages, labor disputes, supply-chain disruptions, government actions, or acts of third-party payment processors.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules. You and Michiana Water agree that any dispute arising from these Terms or our Products and Services will first be addressed through good-faith efforts to resolve it informally. If that fails, the dispute will be brought exclusively in the state or federal courts located in or serving Elkhart County, Indiana, and you consent to that jurisdiction and venue. 20. Changes to the Website and These Terms

Severability. If any provision is found unenforceable, the rest remain in effect.

No waiver. Our failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these Terms without our consent. We may assign them in connection with a sale or transfer of our business.
